Terms and Conditions

This is an Agreement between you and Peer Inc (“we”, “us”, “our”). Please read these Terms and Conditions and Privacy Policy before purchasing or using any aspect of Peer Services. By using any aspect of Peer Services, such as purchasing or consuming Peer Contents on bondoloi, you agree to be bound by the terms of this Agreement on behalf of yourself and all members of your household and others who use Peer Services under your account. If you do not accept the terms of this Agreement, then you may not use the Peer Services.

 

For the purposes of this Agreement:

 

"Content Provider" means the party offering digital contents, which may be us or a third party.

 

"Peer Content" means digital contents obtained from Contents Providers, such as bondoloi storybooks, comics and other content.

 

"Peer Store" means our stores, available through certain Peer Software, such as bondoloi which is located at www.bondoloi.com.

 

"Peer Software" means softwares that we make available that permits users to shop for, download, browse Peer Content, or use the Peer Store, or to create or distribute other contents.

 

"Peer Services'' means the provision of our stores, contents, softwares, support and other services that we provide to our customers.


 

Peer Content

 

Usage. Upon your download or access of Peer Content and payment of any applicable fees (including applicable taxes), the Content Provider grants you a non-exclusive right to view, use, and display such Peer Content, solely through Peer Software or as otherwise permitted as part of Peer Services and solely for your personal, non-commercial use. Peer Content is licensed, not sold, to you by the Content Provider. The Content Provider may include additional terms for use within its Peer Content. Those terms will also apply, but this Agreement will govern in the event of a conflict.

 

Importing, Sharing, and Distributing Content. Peer Services may allow you to import, upload, export, share, submit, or otherwise distribute, content to yourself or others (“Distribute”). You may not Distribute content that contains child sexual abuse or other abusive materials, or that advocates hatred, violence, or terrorism. You may only Distribute content to another if you have their permission; you may not Distribute content that is unsolicited. You may Distribute content solely for your personal, non-commercial use; you may not charge, directly or indirectly, to Distribute content via any Service. You are solely responsible for all content that you Distribute. We take no responsibility and assume no liability for any content that you, or any third party, Distribute. We may investigate any suspected violation or other misuse of any Service, and may review and remove any content and associated metadata. 

 

Limitations. Unless specifically indicated otherwise, you may not sell, rent, lease, broadcast, sublicense, or otherwise assign any rights to the Peer Content or any portion of it to any third party, and you may not remove or modify any proprietary notices or labels on the Peer Content. In addition, you may not attempt to bypass, modify, defeat, or otherwise circumvent any digital rights management system or other content protection or features used as part of Peer Services.

 

Returns and Losses. Return of purchased Peer Contents is not permitted, thus we do not offer a refund. Risk of loss for Peer Content transfers when you download or access the Peer Content.


 

Peer Store

 

Product Descriptions. We attempt to be as accurate as possible. We endeavor to display and describe as accurately as possible the printed colors of physical products, but we cannot give any assurance that the colors supplied will exactly match those displayed on your monitor or mobile telephone. We do not warrant that product descriptions or other content of any Peer Services is accurate, complete, reliable, current, or error-free. 

 

Reviews, Comments and Communication. You may post reviews, comments, photos, videos, and other content; send e-cards and other communications; and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights (including publicity rights), or otherwise injurious to third parties or objectionable, and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam" or unsolicited commercial electronic messages. You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. We reserve the right (but not the obligation) to remove or edit such content, but do not regularly review posted content. If you do post content or submit material, and unless we indicate otherwise, you grant we a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, perform, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant we and sublicensees the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify we for all claims resulting from content you supply. We have the right but not the obligation to monitor and edit or remove any activity or content. We take no responsibility and assume no liability for any content posted by you or any third party.

 

Payment. We do not charge you until after your order has entered the shipping process or, for digital products, until we make the digital product available to you. If we are having difficulties in procuring an order you placed with us, you will be notified via e-mail or phone number. If your payment settlement cannot be authorized by the issuing company, we’ll notify you via e-mail or phone number. If you receive a notification, please follow the steps provided. Your order will be processed and shipped as soon as you change to another payment method provided that payment method is authorized. Please also note that your order may be cancelled if you do not provide a valid payment method within a certain period of time.
 

Orders and Specifications. All physical product orders are subject to product availability and our acceptance of the order. Order shall be deemed accepted by we only after an issuance of the Order Confirmation. We reserve the right to reject any Order without the obligation to assign any reason for doing so. The Order Confirmation will contain details of your Order, the Price and an estimate of the delivery time for the Order. It is your responsibility to notify us of any error or mistake with the Order. Failure to do so may lead to an incorrect delivery.

Delivery and Acceptance. We will endeavor to process and deliver all physical product orders within the stated time for each item. However, manufacturing times may vary and any times quoted for the delivery of goods are indicative only and we will not be liable for any loss or expenses which you may sustain as a result of any delivery delays. Upon delivery, you must inspect them and should there be any sign of defects or non-conformity to your Order, please contact us via our online form. Your claim must include the following information:

  • Your full name, shipping address and Order number;

  • A description of your concern;

  • Image of the product in concern and its affected parts

Otherwise we cannot refund or replace the item, beyond your statutory rights. You must be available to accept delivery on the delivery date, otherwise the delivery will be returned back to us at your expense. If delivery is refused or returned due to a faulty address, you will be charged a return fee. If you wrongfully fail to take delivery of the Order then we shall be under no obligation to refund the price.

Information Provided Under Japan’s Act on Specified Commercial Transactions. The information on this page is provided in accordance with the requirements outlined in Article 11 (Advertisements of Mail Order Sales) of Japan's Act on Specified Commercial Transactions.


 

Peer Software 

 

Account. You may need your own account to use Peer Services, and you may be required to be logged in to the account and have a valid payment method associated with it. If there is a problem charging your selected payment method, we may charge any other valid payment method associated with your account. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account or password. We reserve the right to refuse service, terminate accounts, terminate your rights to use Peer Services, remove or edit content, or cancel orders in its sole discretion.

 

Information Provided. Peer Software will provide information about your usage, including information about its interaction with Peer Content, other content, and services

 

Information Provided to Others. You are solely responsible for any information you provide to others using Peer Services. Use of information you provide to these third parties will be subject to any Privacy Policy or other terms that they may provide to you. 

 

Additional Terms. The following terms apply to any software (including any updates or upgrades to the software) and any related documentation we make available to you in connection with Peer Services.

  1. Use of Peer Software. You may use Peer Software solely for purposes of enabling you to use Peer Services as provided by we, and as permitted by these Terms and Conditions and any Service Terms. You may not incorporate any portion of Peer Software into other programs or compile any portion of it in combination with other programs, or otherwise copy (except to exercise rights granted in this section), modify, create derivative works of, distribute, assign any rights to, or license Peer Software in whole or in part. All software used in any Peer Services is the property of we or its software suppliers and is protected by international copyright laws.

  2. Use of Third Party Services. When you use Peer Software, you may also be using the services of one or more third parties, such as a wireless carrier or a mobile software provider. Your use of these third party services may be subject to the separate policies, Terms and Conditions, and fees of these third parties.

  3. No Reverse Engineering. You may not reverse engineer, decompile or disassemble, tamper with, or bypass any security associated with Peer Software, whether in whole or in part.

  4. Updates. We may offer automatic or manual updates to Peer Software at any time and without notice to you.

  5. Conflicts. In the event of any conflict between these Terms and Conditions and any other we or third-party terms applicable to any portion of Peer Software, such as open-source license terms, such other terms will control as to that portion of Peer Software and to the extent of the conflict.


 

General

 

Copyright. All content included in or made available through Peer Services, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software is the property of we or its content providers and protected by international copyright laws. The compilation of all content included in or made available through Peer Services is the exclusive property of we and protected by international copyright laws.

 

Trademarks. In addition, graphics, logos, page headers, button icons, scripts, and service names included in or made available through Peer Services are trademarks or trade dress of we internationally. We's trademarks and trade dress may not be used in connection with any product or service that is not ours, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits us. All other trademarks not owned by we that appear in Peer Services are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by we.

 

Parental Control. Children’s products and services must be purchased by a parent or guardian with a credit card or other permitted payment methods. If you are under 18, you may use Peer Services only with the involvement or a verifiable consent of a parent or guardian. Parents and guardians may create profiles for teenagers in their Peer Services account. We do not knowingly collect personal information from children under the age of 13, without the consent of the child's parent or guardian. Your child may be able to share information publicly and with others depending on the products and services used. We will not serve interest-based ads to your child when they are using Peer Services. This disclosure does not apply to the practices of any third-party services (including apps, skills, and websites) that may be accessed through Peer Services. Before using any third-party service, you should review the applicable terms and policies to determine their appropriateness for your child, including the service’s data collection and use practices.

 

Affiliates. Parties other than we operate stores, provide services or software, or sell product lines through Peer Service. In addition, we provide links to the sites of affiliated companies and certain other businesses. If you purchase any of the products or services offered by these businesses or individuals, you are purchasing directly from those third parties, not from us. We are not responsible for examining or evaluating, and we do not warrant, the offerings of any of these businesses or individuals (including the content of their Web sites). We do not assume any responsibility or liability for the actions, product, and content of all these and any other third parties. You should carefully review their privacy statements and other Terms and Conditions. 

 

Modification And Severability. We reserve the right to make changes to our policies and terms at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

 

License and Access. Subject to your compliance with these Terms and Conditions and any Service Terms, and your payment of any applicable fees, we or its Content Providers grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal and non-commercial use of Peer Services. This license does not include any resale or commercial use of any Peer Services, or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of any Peer Services or its contents; any downloading, copying, or other use of account information for the benefit of any third party; or any use of data mining, robots, or similar data gathering and extraction tools. All rights not expressly granted to you in these Terms and Conditions or any Service Terms are reserved and retained by we or its licensors, suppliers, publishers, rightsholders, or other content providers. No part of Peer Services may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of we. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of we without express written consent. You may not use any meta tags or any other "hidden text" utilizing we's name or trademarks without the express written consent of we. You may not misuse Peer Services. You may use Peer Services only as permitted by law. The licenses granted by we terminate if you do not comply with these Terms and Conditions or any Service Terms.

 

Procedure for Making Claims of Intellectual Property Infringement. If you believe that your intellectual property rights have been infringed, please submit your complaint using our online form. This form may be used to report all types of intellectual property claims including, but not limited to, copyright, trademark, and patent claims. Your claim must include the following information:

  • A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright interest;

  • A description of the copyrighted work that you claim has been infringed upon;

  • A description of where the material that you claim is infringing is located on the site;

  • Your address, telephone number, and e-mail address;

  • A statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and

  • A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

 

Fraud and Termination. Your rights under this Agreement will automatically terminate if you fail to comply with any term of this Agreement. We may also terminate your right to use Peer Services at any time, including if we determine your use violates any term of this Agreement or involves any fraud or misuse of Peer Services. In case of such termination, you must cease all use of Peer Services, and we may immediately revoke your access to Peer Services without refund of any fees. Failure of us to insist upon or enforce your strict compliance with this Agreement will not constitute a waiver of any of its rights.

 

Changes and Amendments. We may change, suspend, or discontinue Peer Store, Peer Software, Peer Services, in whole or in part, at any time without notice. We may amend any of this Agreement's terms at our sole discretion by posting the revised terms on our website. Your continued use of any Peer Software or any aspect of Peer Services after the effective date of the revised Agreement terms constitutes your acceptance of the terms.

 

Disputes. Any dispute or claim arising from or relating to this Agreement or Peer Services is subject to the sections on dispute resolution, governing law, disclaimer of warranties and limitation of liability. You consent to exclusive jurisdiction and venue in courts and we each waive any right to a jury trial.

 

Governing Law. By using any Peer Service, you agree that the laws of Japan will govern these Terms and Conditions and any dispute of any sort that might arise between you and we.

 

Limitation of Liability. Without limiting the Disclaimer of Warranties and Limitation of Liability, (1) in no event will we or our software licensors' total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) arising out of or related to your use or inability to use any Peer Software exceed the amount of five U.S. dollars ($5.00); and (2) in no event will we or any other Content Provider's aggregate liability to you for all damages arising from your use of any Service (excluding Peer Software) exceed the amount you actually paid for the Peer Content or for the aspect of Peer Services related to your claim for damages. These limitations will apply to you even if the remedies fail of their essential purpose.

 

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

PEER SERVICES AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) AND OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH PEER SERVICES ARE PROVIDED BY PEER INC ON AN "AS IS" AND "AS AVAILABLE" BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. PEER INC MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF PEER SERVICES, OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH PEER SERVICES, UNLESS OTHERWISE SPECIFIED IN WRITING. YOU EXPRESSLY AGREE THAT YOUR USE OF PEER SERVICES IS AT YOUR SOLE RISK.

TO THE FULL EXTENT PERMISSIBLE BY LAW, PEER INC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. PEER INC DOES NOT WARRANT THAT PEER SERVICES, INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH PEER SERVICES, PEER INC'S SERVERS OR ELECTRONIC COMMUNICATIONS SENT FROM PEER INC ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. TO THE FULL EXTENT PERMISSIBLE BY LAW, PEER INC WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF ANY PEER SERVICES, OR FROM ANY INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH ANY PEER SERVICES, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES, UNLESS OTHERWISE SPECIFIED IN WRITING.
